Venom is probably going to be DLC. He's not in most probably because Marvel didn't want him to be in. Apparently the was one of the major reasons why some loved marvel characters didn't make the cut on the disc (venom, gambit, cyclops, ghost rider)

Lucas, there is a heap of characters who people want in that didn't get in. If they answered everyone's requests, you'd get an unbalanced clusterfuck even worse than MvC2.

Also it should be noted, they've stated that they want to have varied playstyles for each character, with no characters playing mostly the same. If there's a character who plays a lot like Venom, he's unlikely to get in.
